3 Important Legal Tips When Dealing With A DUI Charge

Blog

Getting pulled over for a DUI is a scary scenario to be put in. You may think your life is over, but it doesn't have to be. If you handle this terrible situation in the following ways, you can bounce back as quickly as possible.

Watch What You Say

If you plan on contesting the DUI charge later on down the road, it's important to be careful with what you say to the arresting officer. After all, anything you say to this officer can and will be used against you in the court of law.

Be polite and cooperate with the officer, but don't feel the need to answer all of their questions. In fact, it may serve you better just to remain silent when the officer is questioning you. By law, you don't have to answer any questions that you don't feel comfortable with.

Plea Bargain

If you don't have a solid case proving you're innocent in this matter, your best strategy is to plea bargain with the prosecuting attorney. After all, going to court when there is a lack of supporting evidence will only cost you money and time. When plea bargaining, however, you can avoid going to trial completely.

Typically, you'll be required to plead guilty to the DUI. In exchange for this admission of guilt, though, the consequences may be significantly less. The DUI may remain on your record, but instead of losing your license, you may just have to undergo defensive driving or attend an AA (Alcoholics anonymous) meeting.

Hire a DUI Attorney

If there is evidence proving your innocence, however, you should handle this charge by getting help from a DUI attorney. They've dealt with many similar cases in the past, and can thus employ tactics that have proven effective at getting clients off DUI charges.

For example, the arresting officer may have administered the DUI test incorrectly. The results are therefore tainted, and your DUI attorney can compile evidence that shows the officer's negligence. Having this attorney by your side also ensures you say the right things in court, so errors or inconsistent statements are not used against you.

Faced with a DUI charge, you may think that life as you once knew it is over. This charge doesn't have to be forever impactful, though, if you know what legal actions to take during this time. With the right evidence and tactics, you can get back to a normal life again.

Working With Your Attorney

Few things are more frustrating than being accused of a crime that you didn't commit. I found myself in this difficult situation a few years ago when I was with a friend who broke the law. However, I knew that I didn't do anything, which is why I hired an experienced criminal attorney to help me out. He carefully reviewed my case, talked with me about what court would be like, and helped me to wrap my head around the different punishments I might face. He helped to prove my innocence, and I decided to set up this blog to help other people to understand the importance of working with a professional.
